Terms & Conditions:  Carefully read these terms and conditions of use (“Terms of Use”) as they govern your access to and use of iBiome Nursing (“iBiome” “we,” “us,” and “our”) platform. Your acceptance of, and compliance with, these Terms of Use is a condition to your use of the following: our “Website.”  Any supplements (“Supplements”) available for purchase through our website; and services (“Services”) made available through our website.

Confidentiality & Privacy*:  We take your privacy seriously. All patient information, including medical records, is kept confidential and will not be shared with any third party without your written consent, except as required by law. We comply with the Health Insurance Portability and Accountability Act (HIPAA) to ensure your personal health information remains protected.Not For Emergencies.  Our website and its services are not for medical emergencies or urgent situations. You should not disregard or delay seeking medical advice based on anything that appears or does not appear on our website. If you believe you are experiencing an emergency, call 9-1-1 immediately.
HIPAA Privacy Practices*: You agree that information provided by you in connection with the Patient Portal and its Services  shall be governed by this HIPAA Privacy Practices, which is hereby made part of these Terms of Use.

HIPAA Privacy Practices | EMERGENCY COMMUNICATION*: However there may be time when the provider must phone, email or text message you. We will never leave pertinent clinical information on a message.   May we phone, email, or send a text message to you to about your appointments and / or health status.   
WE ARE NOT PRIMARY CARE SERVICES:  We are an adjunct specialty service, wellness*: We require and recommend that you continue to consult with your primary provider and other healthcare professionals/specialists for all your primary care needs. We recommend that you always seek the advice of a physician or other qualified healthcare provider concerning questions you have regarding a medical condition and before stopping, starting, or modifying any treatment.

WE DO NOT PROVIDE URGENT OR EMERGENT CARE SERVICES: Please seek out Urgent or Emergent Care.* Not For Emergencies. Our website and its services are not for medical emergencies or urgent situations. You should not disregard or delay seeking medical advice based on anything that appears or does not appear on our website. If you believe you are experiencing an emergency, call 9-1-1 immediately.

YOUR RESPONSIBILITY*: You agree to notify your healthcare provider of any adverse reactions, side effects, or concerns you experience with compounded medications. You are responsible for ensuring that all information provided to your healthcare provider, including medication history and allergies, is accurate and up-to-date.

FEE POLICY - HEALTHCARE INSURANCE* We do not accept insurance directly. However, we can provide a superbill for you to submit to your insurance provider for reimbursement if applicable. It is your responsibility to check with your insurer about coverage.

REFUND POLICY*. iBiome offers goods and services that are irrevocable. Therefore, we do not issue refunds for any product or service.

FEE POLICY* All fees for services, consultations, and treatments will be disclosed prior to your appointment, we are fully out of all insurance networks. Payment is due at the time of service unless otherwise arranged. We accept payment by [credit card using Stripe, there is a 3.5% CC stripe fee].

CANCELLATION CHARGE*. All cancellations less than 48 hours will have a cancellation charge of $150.00.

RESCHEDULE POLICY.  Rescheduled appointments (within the same month) will not be charged.

LIMITS OF LIABILITY: iBiome Nursing, HNP and its practitioners shall not be held liable for any damages, injuries, or loss resulting from the use of our services, including any adverse reactions to treatments, therapies, or products recommended.

TERMINATION OF SERVICES - PATIENT:  You may choose to discontinue services at any time, all fees will be due upon termination. See Membership Cancellation policy.
TERMINATION OF SERVICES - PROVIDER:  If, for any reason, we find it necessary to discontinue or end the patient-practitioner relationship, we will provide notice and any relevant instructions for transitioning care if needed.

GOVERNING LAW: These terms and conditions are governed by the laws of the State of [State], without regard to its conflict of law principles

RISK OF TELEHEALTH SERVICES:  In 2015, AB 809 revised the informed consent requirements relating to the delivery of health care via telehealth by permitting consent to be made verbally or in writing.   Providers using telehealth technologies to provide care to patients located in California must be licensed in California.  Patients must be a California resident to be a patient at iBiome Healthcare.  Providers are held to the same standard of care, and retain the same responsibilities of providing informed consent, ensuring the privacy of medical information, and any other duties associated with practicing Nursing regardless of whether they are practicing via telehealth or face-to-face, in-person visits.   By agreeing to Telehealth services, you acknowledge the potential risks associated with telehealth services. These include but are not limited to the following: information transmitted may not be sufficient (e.g. poor resolution of images) to allow for appropriate medical or health care decision making by the Provider; delays in evaluation or treatment could occur due to failures of electronic equipment; a lack of access to your medical records may result in adverse drug interactions or allergic reactions or other judgment errors; although the electronic systems we use incorporate network and software security protocols to protect the privacy and security of health information, those protocols could fail causing a breach of privacy of your health information.
Nurse Practitioner Disclaimer: Our Nurse Practitioners are not Medical Doctors.  Our Nurse Practitioners function under Standardized Procedures within their own scope of practice as dictated by the California Board of Registered Nursing, with a Collaborative Physician in the supervisory role.

Supplements: *According to the Federal Food, Drug, and Cosmetic Act, as amended, Section 201(g)(1), the term drug is defined as an “article intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease.” Technically, vitamins, minerals, trace elements, amino acids, herbs, or homeopathic remedies are not classified as drugs. However, these substances can have significant effects on physiology and must be used rationally. Use of nutritional supplements may be safely recommended for patients already using pharmaceutical medications (drugs), but some potentially harmful interactions may occur. For this reason, please consult your health care provider before making any health care decisions or for guidance about a specific medical condition. You are not required to purchase supplements at our dispensary, we make recommendations & earn a small profit from our holistic dispensary, you are free to purchase them outside our practice and dispensary.
